Terms of Service
Last updated 28 October 2026
These Terms of Service (the "Terms") form a legally binding agreement between Strkk Ltd, a company registered in England and Wales that provides the Perksworth product ("Perksworth", "we", "us"), and the business or individual that creates an account ("you", "the Business"). They govern your access to and use of the Perksworth platform, storefronts, APIs, mobile apps and related services (together, the "Service").
1. Agreement to these Terms
By creating an account, clicking to accept, or using any part of the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy and Acceptable Use Policy, which are incorporated by reference.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity. You must be at least 18 years old and legally capable of entering into a contract.
2. The Service
Perksworth provides software that lets local businesses sell subscriptions, memberships, tiered plans, prepaid packages and one-off services; collect recurring and one-off payments; and publish a branded storefront. Features are described on our website and in the product, and may change, be added to, or be withdrawn over time.
We provide the Service on a software-as-a-service basis. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes for as long as these Terms are in force.
The Service is a technology platform. Perksworth is not a party to the contract between you and your customers for the goods or services you sell; you are solely responsible for fulfilling what you sell. You are responsible for giving your customers your own terms of sale, including your cancellation and refund policy.
3. Accounts and security
You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. You must notify us promptly of any unauthorised use or suspected security breach.
You are responsible for your staff, contractors and anyone you invite to your account, and for their compliance with these Terms.
4. Fees and payments
Location fee: Perksworth charges £29 a month for each active location, plus any applicable taxes, such as VAT, at the rate that applies to you. A location is active from the day you activate it. Draft locations are not charged, and nor are head-office or admin-only accounts that do not trade. The location fee is billed monthly in advance to the card you add for platform billing. A location activated part-way through a billing period is charged pro rata for the rest of that period, before it activates.
Introductory period: your business’s first activation starts an introductory period of 7 days, during which location fees are not charged; locations activated during it are free until it ends. The first charge date is shown when you activate. The introductory period applies once per business: reactivating a location, or opening a new billing account for the same business, does not start a new one.
Payment fee: Perksworth charges 2% of the gross value of each payment collected through the Service, including any applicable taxes. There is no payment fee on payments you take outside the Service (such as cash or a card terminal), on bookings, or on token redemptions. The payment fee is fixed when the payment is taken; a refund returns the matching share of it.
Payment processing: card processing is provided by our payment partner Stripe and is charged to you at cost; that is, the processing fees are passed through to you at the rates charged by the processor, with no mark-up by Perksworth.
Text messages and phone calls: if you turn on texts or calls, each one is charged at the rates published on our pricing page at perksworth.com/pricing, which can vary by country and destination, plus any applicable taxes, and billed with your location fees.
Payment fees and processing fees are deducted from the funds collected on your behalf before payout, or invoiced where deduction is not possible. Any applicable taxes, such as VAT, are added on top of the location fee. The payment fee includes any applicable taxes, and none are added on top of it. Our invoices and statements show the tax part separately. Payment-processing fees are charged on the payment processor’s own terms. You are responsible for your own tax obligations, including charging, collecting and remitting any taxes due on your sales.
Failed payments: if a location-fee payment fails, we tell the person who manages billing and retry the payment. If it is still unpaid 7 days after the first failure, new sales and bookings are restricted until it is paid. Your records, refunds and the fulfilment of what customers have already paid for continue, paid customer entitlements are kept, and new membership renewal collections are paused. Access is restored once payment is confirmed.
Cancellation: you can cancel a location at any time. Cancellation takes effect at the end of the period you have already paid for, the location does not renew, and the location fee for the current period is not refunded. You can undo a cancellation before it takes effect. A location activated again after its cancellation took effect is billed from that day, with no new introductory period.
Prices may change. We may change any of our prices, including the location fee, the payment fee and the rates for text messages and phone calls, on at least 30 days’ notice by email. Current prices are always published at perksworth.com/pricing. If you do not agree to a change, you may close your account before it takes effect.
5. Payouts and payment processing
To collect payments you must connect a Stripe account and complete the identity and business verification required by our payment partner. Payouts are made to the bank account you designate, subject to the payout schedule, verification checks, reserves and holds that Stripe may apply.
Your use of payment processing is also subject to the terms of the relevant payment partner (for example, the Stripe Connected Account Agreement). You are responsible for chargebacks, refunds, and disputed transactions relating to your sales, and we may recover these amounts (including associated fees) from funds we hold or collect on your behalf.
6. Your content and your customers
You retain ownership of the content you upload (logos, images, descriptions, prices, and similar) and of your relationship with your customers. You grant us a licence to host, reproduce and display that content solely to operate and provide the Service.
You are responsible for the accuracy and lawfulness of what you sell and advertise, for honouring the plans, memberships and refunds you offer, for consumer-law compliance (including cancellation and cooling-off rights where they apply), and for providing your own terms and privacy notice to your customers.
Where we process your customers’ personal data on your behalf, we do so as your processor under the Data Processing Agreement.
7. Acceptable use
You must use the Service in accordance with our Acceptable Use Policy and all applicable laws. You must not sell prohibited or restricted goods or services, engage in fraud or money laundering, infringe others’ rights, or attempt to disrupt, reverse engineer or gain unauthorised access to the Service.
8. Intellectual property
The Service, including its software, design, and the Perksworth name and marks, is owned by Strkk Ltd and its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you, we reserve all rights. You must not remove any proprietary notices or use our marks without permission.
9. Service availability and support
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may modify or discontinue features. We provide support by email; response times are on a commercially reasonable-efforts basis.
10. Suspension and termination
You may close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required to protect the Service, our other customers or payment partners, if required by law, or if your account presents unacceptable fraud, chargeback or legal risk.
On termination, your right to use the Service ends. Outstanding fees remain payable, and we will handle your data in accordance with the Privacy Policy and Data Processing Agreement, including making it available for export for a reasonable period where practicable.
11. Warranties and disclaimers
Except as expressly stated, the Service is provided "as is" and "as available" and we disclaim all other warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence or for fraud.
Subject to that, we are not liable for loss of profits, revenue, goodwill, business or anticipated savings, or for any indirect or consequential loss. Our total aggregate liability arising out of or in connection with these Terms in any 12-month period is limited to the greater of the platform fees you paid us in that period or £100.
13. Indemnity
You agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your content, the goods or services you sell, or your infringement of any third party’s rights or of applicable law.
14. Changes to these Terms
We may update these Terms from time to time. For material changes we will give reasonable notice, for example by email or in-product notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property or recover amounts owed in any competent court.
